Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the mobile games and related services (“Service”) provided by Surge Games Teknoloji Anonim Şirketi (“Surge Games”, “Company”, “We”, “Us”, “Our”).
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Scope note: These Terms apply to all Surge Games titles. Some clauses (e.g., relating to advertising, in-app purchases, or specific features) only apply to titles in which those features are present. The features available in any given game are described in that game’s store listing and within the game itself.

2. Eligibility
Our games are designed to be suitable for players of all ages and are rated accordingly on the App Store and Google Play.
If you are a minor under the age of majority in your country (typically under 18), you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the Service.
We do not knowingly collect personal data from children. See our Privacy Policy for details on how we handle data with respect to younger players.
3. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your personal, non-commercial entertainment use.
You may not:
- Copy, modify, translate, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the Service, except to the extent such restriction is prohibited by applicable law
- Distribute, sell, rent, lease, or sublicense access to the Service
- Use cheats, automation tools, bots, mods, hacks, or any unauthorized third-party software that interacts with the Service
- Circumvent, disable, or interfere with security or technical limitations
- Access the Service to build a competing product or for any commercial purpose
All rights not expressly granted are reserved by Surge Games and its licensors.
4. In-App Purchases and Virtual Items
Some games may offer optional in-app purchases of virtual currencies, virtual items, or other digital content (collectively, “Virtual Items”).
4.1 General
- Virtual Items are licensed to you, not sold. You do not own them.
- Virtual Items have no monetary value and cannot be redeemed for real currency.
- Virtual Items cannot be transferred, traded, or resold outside the Service.
- We may modify, suspend, or remove Virtual Items at any time.
4.2 Payment
All in-app purchases are processed by Apple App Store or Google Play Store. We do not receive or store payment card information. Your purchase is also subject to the terms of the platform on which you bought it.
4.3 Refunds
Refunds for in-app purchases are governed by the refund policies of the App Store (Apple) or Google Play Store (Google), as applicable. To request a refund, please contact the relevant platform directly.
Nothing in these Terms limits any statutory consumer rights you may have under applicable law (including under Turkish Law No. 6502 on Consumer Protection, the EU Consumer Rights Directive, and equivalent laws in your country of residence).
4.4 EU/UK Right of Withdrawal — Digital Content
If you are a consumer in the EU or UK, you have a 14-day right of withdrawal for digital content purchases. However, by initiating an in-app purchase and confirming that you wish to receive the Virtual Item immediately, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal once delivery has begun.
5. Advertising
Some of our games may be supported by advertising, including banner, interstitial, and rewarded video ads delivered through third-party advertising networks.
Where advertising is present in a game:
- You agree to view advertisements as part of the Service
- “Rewarded” ads are optional — you may choose to view them in exchange for in-game rewards
- Surge Games is not responsible for the content of third-party advertisements
- Information about ad-related data processing is described in our Privacy Policy
If a game does not currently include advertising, this section does not apply to that game.
6. User Conduct
You agree to use the Service lawfully and not to:
- Exploit bugs, glitches, or unintended behavior to gain unfair advantage
- Attempt to access areas of the Service you are not authorized to use
- Interfere with, disrupt, or place undue load on our servers or infrastructure
- Use the Service to violate any applicable law or regulation
- Engage in fraud, including fraudulent in-app purchase activity or chargeback abuse
Violation may result in suspension or termination of your access.
7. Feedback and Communications
If you send us feedback, suggestions, or ideas about the Service via email or any other channel (“Feedback”), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use that Feedback for any purpose, including improving the Service, without obligation or compensation to you.
You represent that any Feedback you provide is your own and does not infringe on third-party rights.
8. Intellectual Property
All content, software, code, artwork, music, sound effects, characters, designs, trademarks, logos, and other materials included in the Service are owned by Surge Games or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms transfers any ownership rights to you. You may not use any Surge Games intellectual property without our prior written permission, except as expressly permitted by these Terms or applicable law (e.g., fair use).
9. Privacy
Your use of the Service is also governed by our Privacy Policy, available at https://surgegames.co/privacypolicy. Please review it carefully.
10. Apple App Store Terms (iOS Users Only)
If you downloaded a Surge Games app from the Apple App Store, you acknowledge that:
- These Terms are concluded between you and Surge Games — not with Apple — and Surge Games (not Apple) is solely responsible for the app and its content.
- Your use of the app is also governed by Apple’s Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). In the event of any conflict between these Terms and Apple’s EULA, Apple’s EULA governs with respect to the Apple-required terms.
- Apple has no obligation to provide maintenance or support services for the app.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
11. Third-Party Services
The Service integrates third-party platforms and SDKs (e.g., Apple App Store, Google Play Store, Firebase, Adapty, and — where applicable — advertising networks). We are not responsible for the practices, content, or terms of these third parties. Their respective terms and privacy policies apply separately.
12. Suspension and Termination
We may suspend or terminate your access to the Service, with or without notice, if you:
- Violate these Terms
- Engage in fraud, chargeback abuse, or other unlawful activity
- Cause harm to the Service, its users, or our reputation
- Create legal or security risk for Surge Games
Upon termination, your license to use the Service ends. Sections that by their nature should survive (Intellectual Property, Limitation of Liability, Governing Law, etc.) will survive termination.
You may stop using the Service at any time by uninstalling our games.
13. Service Availability and Changes
The Service is provided on an ongoing basis but we do not guarantee continuous availability. We may, at any time:
- Modify, suspend, or discontinue any game or feature
- Release updates that change gameplay or content
- Sunset older versions of games
Where we discontinue a paid game or feature you have purchased, we will provide reasonable notice where required by applicable consumer law.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not guarantee:
- Continuous, uninterrupted, or error-free operation
- That defects will be corrected
- Compatibility with all devices or operating systems
- That the Service will meet your specific requirements
This section does not exclude or limit warranties or rights that cannot be excluded under applicable consumer law. If you are a consumer, you have statutory rights under the law of your country of residence that are not affected by these Terms.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Surge Games shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or loss of goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for direct damages shall not exceed the greater of (a) the amount you paid to us through in-app purchases in the 12 months preceding the event giving rise to the claim, or (b) fifty Turkish Lira (₺50).
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be limited or excluded under applicable consumer law (including Turkish Law No. 6502, the EU Consumer Rights Directive, and equivalent laws)
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Surge Games from claims, damages, and expenses arising from:
- Your unlawful use of the Service
- Your material breach of these Terms
- Your infringement of third-party rights
This section does not apply to consumers to the extent prohibited by applicable consumer law.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles.
Disputes with non-consumers shall be resolved exclusively by the courts of Istanbul Anatolian Courthouse, Turkey.
If you are a consumer, you may also bring proceedings in the courts of your country of residence, and you benefit from any mandatory consumer-protection rights of that country that cannot be derogated from by agreement.
18. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a new “Last Updated” date. For material changes, we will provide additional notice (e.g., in-game notice or email) where required by applicable law.
Continued use of the Service after the updated Terms take effect constitutes acceptance.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and (for iOS users) Apple’s Licensed Application End User License Agreement, constitute the entire agreement between you and Surge Games regarding your use of the Service. They supersede prior agreements between us on this subject.
